This User Agreement should be read in conjunction with our PRIVACY AND SECURITY POLICY and our PAYMENT TERMS.

 

If you do not accept the terms of this agreement you cannot use this service.

 

Definitions

 

"Company" means Top Tradespeople Ltd (registered company number: 06585105) registered office - Kemp House, 152-160 City Road, London EC1V 2NX.

 

"Customer member(s)" means - person, persons, companies or other organisations using the website in order to find tradespeople in order to use the services of tradesperson and/or the tradesperson's subcontractors or to be introduced to tradespeople and/or their subcontractors.

 

"Tradesperson member(s)" means - tradesmen, tradeswomen, trades people, tradespeople, companies or any other person, persons, company, or companies that use the services of the Company and/or the use of the website in order to receive job alerts and accept job leads and/or introductions to member customers and prospective customers, with the purpose of providing goods and/or services to these prospective customers.

 

"E-mail(s)" means - electronic mail received or sent by the Company, created and sent by a member of the Company, or automatically created and sent on behalf of the Company.

 

"Job(s)" means - work carried out by tradespeople.

 

Job Posting(s) means Postings made on the site which describe jobs or work required by tradespeople.

 

"Member(s)" means Users of the site either tradespeople members or customer members.

 

"Disabled" means - the disabling by the Company of the member customer or member tradesperson's account with Top Tradespeople as a result of which the member customer or member tradesperson will not be post new jobs and/or accept or receive new job leads or use any of the services provided by the Company or the website.

 

"Service(s)" means - the services and procedures provided/used by the Company to member tradespeople and member customers which includes, but is not limited to: information, products and services provided by telephone, fax, email or mail, on the

 

"Sub-Contractor(s)" means - contractors, sub-contractors, and self-employed tradespeople, or any other person or company working for or on behalf of member tradespeople.

 

"System(s)" means all components which make up the website and enable the provision of any services of the Company.

 

"Third Party" or "Third Parties" means any other organisation, person or persons being referred to in the context of this agreement other than the Company and member customers or member tradespeople.

 

"Website" means - the content and graphics, web space, web pages and any other content contained in such space or pages which are under the editorial control of the Company and its authorised members.

 

"Your Information" means - any information you provide to us or other members of the Website in relation to the Top Tradespeople service including information provided during registration, job postings, reviews of tradespeople, general feedback and any other communication or information provision which from the use of our services and/or this website.

 

1. Disclaimer member customers

 

a. You confirm that it is your responsibility to select a tradesperson and to organise the terms of any contract entered into with the tradesperson selected or the terms of any work schedule with your selected tradesperson and that the Company makes no warranty whatsoever regarding any goods or services purchased or obtained through a tradesperson introduced via the website or the use of the Company's services or any transactions entered into.

 

b. The Company relies on registering tradespeople to decide which tradespeople are to be included in the database of available member tradespeople accessible for introduction via the Website and the Company does not therefore recommend or endorse any specific tradesperson's services or the services of any tradesperson's subcontractors.

 

c. Whilst the Company shall use its reasonable endeavours to do so, it does not guarantee to find a tradesperson to provide quotes for any Job posted or that any tradesperson will contact the customer regarding a job posted.

 

d. The Company cannot accept any liability in respect of any contract or other agreement entered into between the Customer and the tradesperson. The Company accepts no liability whatsoever regarding the quality or fitness for purpose of any Workmanship provided by any tradesperson that the customer sources through the use of the Company's services and therefore shall not be liable to the Customer for any occurrence resulting from the introduction of the tradesperson to the customer including but not limited to any direct, indirect or consequential or inconsequential loss of any kind suffered by the customer howsoever arising.

 

2. Disclaimer Member Tradespeople

 

a. The Company relies on information provided by member customers regarding job descriptions and general information regarding job postings. The Company makes no warranty for the accuracy or completeness of any information provided by the Customer using the services of the Company.

 

b. The Company makes no guarantee to provide any job leads to a member tradesperson.

 

c. As the Customer retains the right to modify or withdraw its Job posting in the absence of a contract or other binding agreement with a tradesperson, the Company makes no warranty as to the availability or suitability of a specific Job and is therefore not liable to the member tradesperson including but not limited to any direct, indirect or consequential or inconsequential loss of any kind suffered by the tradesperson as a result of cancellation or withdrawal of a job posting by a member customer.

 

d. We rely on information provided by member tradespeople regarding their legal ability to accept a job and member tradespeople are therefore responsible for ensuring that they are legally able to accept a job lead and legally able to perform the work duties involved in the specified job posting.

 

e. The Company is not party to any contract entered into between the tradesperson member or the customer member in relation to any job posting and accordingly shall not be liable to the member tradesperson for any occurrence resulting from the introduction of the customer to the tradesperson including but not limited to any direct, indirect or consequential or inconsequential loss of any kind suffered by the member tradesperson howsoever arising.

 

3. Disclaimer of warranties

 

a. The Company makes no guarantee or warranty that the Website or use of the Company's Services will meet your requirements or will be uninterrupted, timely, secure or error-free.

 

4. Your Privacy And Information

 

a. Please refer to our privacy policy. This agreement should be read

 

in conjunction with our PAYMENT TERMS and PRIVACY POLICY.

 

5. The Rights Of The Company

 

a. The Company reserves the right to modify or discontinue all or part of, temporarily or permanently, the Website or the Service with or without notice to you and you confirm that the Company shall not be liable to you or any Third Party for any modification to or discontinuance of the Website or the Service.

 

b. The Company may change the terms and conditions of use of the website as necessary and from time to time and shall post such alterations on this Website.

 

c. The content, layout and organisation of the Website and the Company's services shall be subject to variation at the sole discretion of the Company.

 

d. Should the Company's publication of the Website or provision of the Company's service be restricted, curtailed or prevented by any law or any other act or thing beyond the Company's control, the Company may at any time, notwithstanding anything contained in this Agreement, forthwith terminate this Agreement in whole or in part.

 

This Agreement shall be subject to the laws of England and Wales and the parties shall submit to the exclusive jurisdiction of the English courts.
